General Terms and Conditions (GTC) for www.raices.ch
Scope and Acceptance
The following General Terms and Conditions (GTC) govern the business relationship between Raices (Felix Moran, Hinterhaldenstrasse 11, 5213 Villnachern, hereinafter referred to as “Raices”) and its customers (hereinafter referred to as “Customer”) in the context of online shopping via the website www.raices.ch..
By placing an order, the Customer irrevocably accepts these GTC and confirms that they have read and understood them.
1. Purpose and Scope (Product Description)
Raices offers its products to customers who wish to purchase high-quality Ecuadorian hats and other handcrafted items at fair prices. Raices provides products that are made with the utmost care by artisans from various villages in Ecuador, including straw hats, waterproof felt hats made from sheep’s wool or alpaca, as well as accessories made from wool and leather.
2. Data Protection
Your personal data is used in accordance with our Privacy Policy to process your order, enhance your experience on this website, and for other purposes described therein. The Privacy Policy is an integral part of these Terms and Conditions.
3. Ordering and Shipping
Delivery Area: Deliveries are generally made within Switzerland and Liechtenstein. Deliveries to other European countries outside Switzerland and Liechtenstein are also possible. For retail customers, the shipping costs indicated in the shopping cart apply. B2B orders are not processed through the webshop; instead, individually agreed terms apply.
Postage/Shipping Costs: Postage is charged according to the information provided in the order. Transport insurance is included in the postage in accordance with the shipping provider’s terms and conditions. If delivery is made in partial shipments for technical reasons, no additional shipping costs will be charged to the customer.
Shipping Partners: Shipping is typically handled by Swiss Post, DPD, or DHL.
Contract in force:
- Orders paid by bank transfer or cash do not constitute a mutual obligation to deliver or pay until the payment has been successfully received.
- The purchase contract becomes effective only after successful and full payment of the ordered goods, or in the case of payments made via Twint or credit card. Raices is only obligated to deliver from that point onward.
4. Payment
All goods must be paid for in advance.
Bank Transfer / Cash Payment:
- For payments made via bank transfer, processing may take up to three (3) business days. The goods will only be shipped after the payment has been successfully received, which may extend the stated delivery time.
- Payments can also be made via Twint to the number +41 79 597 41 84.
- Cash payment is only possible if the goods are handed over in Villnachern or at a location agreed upon with Raices.
Credit Card Payments / Twint: For payments made by credit card or Twint, Raices is obligated to ship the goods immediately, ensuring a typical delivery time of 2 to 3 days.
4.1. Refunds
Refunds are issued exclusively via bank transfer to the account specified in writing by the customer.
5. Delivery
Delivery Times: The standard delivery time is two (2) to four (4) business days within Switzerland and Liechtenstein. Shipments to other countries may take up to ten (10) days.
Delay and Withdrawal: If the delivery time is not met, the buyer is entitled to set a reasonable grace period for delivery in writing. If this period expires without success, the buyer is entitled to withdraw from the contract and request a refund. Further claims for damages are excluded.
Return Shipments (Address Errors / Non-Collection):
- If goods are returned due to incorrect or incomplete address information provided by the customer, they will be stored at Raices for two (2) weeks. If no address correction is made within this period, the contract is considered terminated and Raices is released from its delivery obligation.
- The customer shall bear the postage costs for the return shipment and any subsequent re-delivery in all cases.
6. Images/Fotos and Product Representation
The images are intended to visually represent the products. All images are created with the utmost care. Since the headwear is made from natural materials, slight variations in color and texture between the product and the image may occur. Color reproduction also depends on the customer’s display device. Variations in the displayed colors do not constitute a defect.
7. Product Availability
Raices points out that part of its product range consists of seasonal or limited-edition fashion items. If an ordered product is no longer available, the customer will be informed as soon as possible. The customer may choose an alternative product or request a full refund for the unavailable item. Any further claims by the customer are excluded.
8. Exchange / Exchange for Defective Delivery
Return Policy: Products that do not fit (size exchange) may be exchanged for a different size. Items must be in perfect, unworn condition and returned to Raices within ten (10) days of receipt.
Exclusions: Worn, damaged, altered, or washed products are excluded from exchange. Special offers and promotional items are also excluded.
Defective Deliveries (Warranty): In the case of defective deliveries (faults), the customer will receive a free replacement or repair. If this is not possible, the customer will be issued a credit or a refund of the purchase price.
9. Returns (Withdrawal)
Procedure for Defects: If a manufacturing defect is present or an incorrect product has been delivered, the customer is required to contact Raices immediately (no later than within 7 days) to arrange the next steps (exchange/return).
Products returned without prior consultation with Raices or not collected from the postal service will not be refunded. Worn, altered, or damaged products cannot be returned.
10. Promotions
Offers are valid while supplies last. In the case of multiple orders for the same product, the first order with successful payment will be prioritized. Exchange and return are strictly excluded for promotional items and products marked as “SALE.”
11. Data Protection
Principle: In accordance with the Swiss Data Protection Act (DSG), personal data is treated with strict confidentiality and is not sold to third parties. Data is used solely for processing your order and sending newsletters.
Deletion/Correction: Customers may request the correction of incorrect data or deletion from our databases at any time. However, due to tax and commercial regulations, complete deletion of order data is only possible after ten (10) years.
Technology: The website uses services from Google and Bing, which may set cookies. These cookies can be deleted by the customer at any time via their browser settings.
12. Prices
Raices accepts no liability for typographical errors. Raices reserves the right to update prices at any time in response to market dynamics in Ecuador and Switzerland. The prices listed in the webshop at the time of the order shall apply.
13. Applicable Law and Jurisdiction
These Terms and Conditions, as well as all contracts concluded via the website www.raices.ch, are governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes is Brugg, Canton of Aargau. For consumers residing in Switzerland, the place of jurisdiction is either the customer’s place of residence or Brugg.
